Hookset Terms of Service
These terms are an agreement between you and KAL Foundry, LLC ("KAL Foundry", "we", "us") about your use of the Hookset app and its related services. By using Hookset, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Hookset.
1. Who can use Hookset
You must be at least 13 to use Hookset, or have a parent or guardian's permission where the law allows it. You may use Hookset only for your personal, non-commercial use.
2. Your account
Hookset works offline and can start a guest account automatically. You can link it to an email address, Apple or Google. Keep your phone and sign-in methods secure. You are responsible for activity on your account. A guest account that is not linked may not be recoverable if you lose your phone or remove the app.
3. Your content
You own the catches, photos, notes and other content you add ("your content"). You give us permission to store, copy, process and display your content only as needed to run Hookset for you. This includes syncing, backups, the AI features you choose to use, and showing anything you publish. This permission ends when you delete the content or your account. It does not cover copies other people already saw or saved from public features.
Only add content you have the right to use. Do not upload photos of other people without their permission.
4. Community features
Local Waters, public angler profiles and monthly Jams are optional. When you publish something, other Hookset users can see what was shown in the preview or on your profile. Jams are for fun: there are no prizes and results are not certified. Enter measurements honestly; we may remove Jam entries, awards or profile content that appear false. You agree not to post anything that is illegal, harassing, hateful, sexually explicit, misleading or spam. Do not post another person's private information or try to find out who posted an anonymous mark. We may remove public content or limit access to public features if it breaks these terms. Removing public content does not delete your private journal.
5. Fishing rules, safety and estimates
- Hookset does not determine fishing regulations. Species notes are your own notes. Any rule references are general information that may be incomplete or out of date. Always check the current rules with the official agency for your water.
- The license wallet stores a personal copy of your documents. It may not be accepted as proof of a license. Carry whatever your jurisdiction requires.
- AI species suggestions, size and weight estimates, bite scores, forecasts and weather are estimates. They can be wrong. They are not certified measurements and must not be used for tournaments, records, harvest limits or consumption decisions.
- Fishing and being on the water carry risks. You are responsible for your own safety, for following the law and for respecting private property.
6. Hookset Pro subscriptions
- Hookset Pro is optional. It is offered as the Weekender and Pro Angler plans, monthly or yearly, and as a one-time lifetime purchase, at the prices shown in the app before you buy. Packs of AI credits are optional one-time purchases for subscribers. Everything is sold and billed by the Apple App Store or Google Play.
- Subscriptions renew automatically until you cancel, according to the store's rules. You can cancel in your App Store or Google Play account settings. Deleting the app or your Hookset account does not cancel a subscription.
- Refunds are handled by Apple or Google under their policies.
- The Pro Angler yearly plan may include a free trial for new subscribers. When a trial ends, the subscription renews at the price shown unless you cancel at least 24 hours before the end of the trial. Introductory offers for returning subscribers apply to the first year only and are shown with their price and conditions in the app.
- Credits never expire while your account exists, are spent only after a feature's monthly allowance is used up, and are removed again if the purchase is refunded. A lifetime purchase includes a one-time allotment of credits, shown in the app.
- AI features have monthly allowances and fair-use limits, which are shown in the app and may change. AI features depend on outside providers and may sometimes be unavailable.
- Logging catches by hand, gear, setups, trips, privacy controls, data export and account deletion never require Pro.
7. Acceptable use
Do not misuse Hookset. For example, do not try to access other users' data, interfere with or overload our services, reverse engineer the app except where the law allows, get around usage limits or payment, or use Hookset to break the law.
8. Third-party services
Hookset relies on other services, such as app stores, sign-in providers, hosting, AI, weather, maps and barcode lookups, as described in our Privacy Policy. Their own terms apply to them, and we are not responsible for them.
9. Our app and changes
Hookset, its design, artwork, sounds and included content belong to us or our licensors. We give you a personal, non-transferable license to use the app under these terms. We may change, add or remove features. If a change materially affects a paid feature, we will try to give notice in the app. Your data is saved on your phone first, but please export it from time to time (Settings → Your data → Export my data).
10. Ending your use
You can stop using Hookset at any time and delete your account in Settings. See Delete your Hookset account. We may suspend or end your access if you seriously or repeatedly break these terms, or if we are required to by law.
11. Disclaimers
To the extent the law allows, Hookset is provided "as is" and "as available," without warranties of any kind. We do not promise the app will be error-free or always available, or that estimates or information in it are accurate. Some places do not allow some of these disclaimers, so they may not apply to you.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim about Hookset is limited to the greater of the amount you paid us for Hookset in the 12 months before the claim, or 50 U.S. dollars. Some places do not allow these limits, so they may not apply to you.
13. App store terms
These terms are between you and us, not Apple or Google. Apple and Google are not responsible for Hookset or its support. If you downloaded Hookset from the App Store, you also agree to Apple's usage rules, and Apple's standard end-user licence terms apply to the extent they are stricter than these. Apple and Google are third-party beneficiaries of these terms and may enforce them against you. We, not Apple or Google, are responsible for the app, its maintenance and support, any warranty, product claims, third-party intellectual property claims and the handling of your data.
14. Governing law and disputes
These terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules, except where the consumer protection law of the place you live requires otherwise. Courts located in Delaware have exclusive jurisdiction and venue for disputes about Hookset, unless the law where you live gives you the right to bring a claim elsewhere. Before filing a claim, please contact us; most problems can be solved quickly by email.
15. Changes to these terms
We may update these terms. We will change the effective date, and we will tell you in the app before significant changes apply. If you keep using Hookset after that, you accept the updated terms.
